Elder law: Can I Do It?
Many of us are concerned about the high cost of lawyers, & feel that we can now go online & find all the free forms & free advice we require. While it is commendable to arm oneself with information, the turf of elder law & Medicaid planning is not a do-it-yourself scheme!
One simple instance: You find a form for a power of lawyer online & then sign it, or have your parent notice it. It was either free or $15, so you feel pretty fine about it. After all, did not you just save a huge legal fee? But what you failed to observe is that several critical provisions were mislaid from this “generic” power of lawyer form, & when the time comes that you require using the form, it is too delayed to get it fixed. So now you are faced with expenses of thousands of dollars, while the attorney’s charge for preparing his top-of-the-line tough general power of attorney may have been just $150 or so, as it charged by lots of NJ Elder Law Lawyer.
Another instance is with Medicaid scheduling. You heard or read somewhere that it is a good thought to have your father present away his possessions, so he will be “deprived” when he goes for Medicaid, thus shielding his wealth. So now your father is barred from Medicaid eligibility for a lot of months or years, when passed through proper & cautious planning by a Medicaid specialist attorney.
